Abstract

This project analyses how viable the traditional legal concept for the demarcation of spheres of freedom via the concept of "permissible risk" is when the inescapable corporeality of each individual becomes a risk for others. It will provide the essential theoretical framework for both the justification and the limitation of interventions in individual freedom, social life and economy in the face of the Corona crisis. In addition to a normative toolkit for crisis handling, the principle based development of standards for assessing and remeasuring the permitted risk serves as a starting point for further research on freedom-oriented responses to pandemic crises in all areas of law.
